Constitution And Rules

Powers of the Executive Committee

1. To appoint Sub-Committees from among its members or from the members of the Association for the purpose of carrying out the objects of the Association.
2. To appoint Sub-Committees of its own members and with or without members of the Association for special purposes, and delegate to such Sub-Committees such functions and powers as may be necessary.
3. From time to time to give clarifications and make rules not inconsistent with the Memorandum of the Association or these Articles as may be necessary or expedient or convenient for the proper conduct, management and control of the Association and its properties and effects.
4. To engage and dismiss Office Secretary and other officers and servants and employees of the Association and to determine their respective powers and duties to fix their wages or remuneration.
5. To determine and to make arrangements as to who shall be entitled to sign, on the Association's behalf, cheques, bills, receipts, vouchers, hundies, contracts and other documents of whatsoever nature.
6. To enter into all negotiations and contacts and to resolve and vary all such contracts and to do all such acts, deeds and things in the name and on behalf of the Association as they may consider expedient for on in relation to any of the matters aforesaid or otherwise for the purpose of the Association.
7. To purchase all articles and things and also to purchase, take on lease or otherwise acquire any lands or buildings, houses or other immovable property as may be necessary or expedient for the purpose of the Association and to pay for the same in cash or otherwise.
8. To commence, institute, process and defend all actions and suits as the Executive Committee may deem fit and necessary and settle, compromise and compound and withdraw the same.
9. To prescribe scales of fees in connection with arbitration and other matters in respect of all or any disputes and actions brought before the Association.
10. To consider (accept or reject) the applications for membership of the Association.
11. If the member of the Executive Committee fails to attend '3' consecutive meetings without proper leave of absence the membership of such member will be automatically cancelled. The Executive Committee will be empowered to fill up the vacant post.
12. To take action or remove any member from the membership of the Association according to provisions contained in Paras V and VII.
13. To carry out the instructions and directions of the General House.
14. To bring about the settlement of disputes between members and members, and members and non-members.
15. To appoint Arbitrators, Umpires, Appellate Authority for settling disputes between members and members, and members and non-members and to make rules & regulations governing the proceedings for arbitration, etc. In case of any dispute between members of the Association the same shall be referred to the Arbitrator whose Decision shall be binding on the members.
16. To fill the vacancy caused by the resignation or expulsion or death for any member of the Executive Committee.
17. To take suitable action against any member who is found guilty of disregarding rules and decisions of the Association.
18. To reconsider its previous resolution in the following cases:
(a) On the recommendation of the President.
(b) On the written request of at least one-third members of the Executive Committee.
(c) On the request at least one-fourth of the members of the General House or a minimum of 40.
19. To appoint auditors for auditing the Accounts of. the Association and to submit report to the General House for confirmation.
20. The President and the General Secretary will be ex-officio members of all the Sub-Committees appointed by the Executive Committee.
21. To affiliate any other association with this Association or this Association with any other Association, Chamber or Federation and when found necessary and expedient to disaffiliate with the same.
22. Dispute & Quida Committee:
(a) In case any member or non-member does not comply with any directions or instructions of the Association and refuses to abide by it, the Executive Committee shall issue a notice to such person asking him to abide by the same, and on his failure to comply with the said notice within the period specified therein, the General Secretary shall report the case to Quida Committee who may notify all members not to have any dealings with such person.
(b) The Quida Committee shall be nominated and its membership fixed by the Executive Committee.
