Constitution And Rules

Retirement and Expulsion of Members

1. Any member may withdraw from the Association by giving not less than one calendar month's notice in writing to the General Secretary, of his intention to do so and upon the expiration of the notice period he shall cease to be a member.
2. Notwithstanding anything in the preceding article, the Executive Committee may refuse to accept the resignation of a member unless and until he has paid to the Association all arrears of subscription or any other sums which may be due from him to the Association.
3. Any member shall cease to be a member of the Association, if the member shall be adjudicated insolvent. A Member being a company or corporation shall cease to be a member if any effective resolution shall have been passed, or an order made by a competent court, for the winding up of the said company or corporation.
4. A firm shall not cease to be a member by reason of a change in the constitution of the firm occasioned by the admission or retirement or death of a partner provided the business of the firm is continued in the conventional name in which such firm was admitted a member.
5. If the Executive Committee of the Association is of the opinion that a member has been guilty of conduct detrimental or prejudicial to the interests of the Association, it may issue a notice giving such member 14 days, time to show cause why he should not be suspended from the membership of the Association.
6. On receipt of the explanation given by the member, if the Executive Committee is satisfied that the explanation is in order, then the Executive Committee may drop the matter. If the Executive Committee is not satisfied by the Explanation given by the member concerned it may suspend or remove the name of the member concerned from the membership of the Association by recording its reasons for arriving at such a decision. Such an action will be taken by passing a resolution by majority of not less than 2/3rds of such members entitled to vote who are present in person at the meeting of the Executive Committee of which notice specifying the intention to propose the resolution has been duly given to all members of the Executive Committee. However, such resolution must be approved by the General Body in the next meeting.
7. On passing of such a resolution by the Executive Committee of the Association, the member shall forthwith be deemed to be suspended or expelled as the case may be and shall not have any claim against the Executive Committee or the Association.
8. No member suspended or expelled under the above Articles shall be entitled to refund of subscription or admission fee.
9. The following acts or omissions shall be considered detrimental and prejudicial to the interest of the Association.
(a) For neglecting or refusing to submit or abide by and carry out any award or decision or order of any Arbitrators or Surveyors or Umpire made in confirmity with the bye-laws or Articles of Association.
(b) For disclosing directly or indirectly any confidential information or document which is in possession of the member in the position of a confidant or trustee.
(c) For any activity or conduct towards the Association or its body of members which is considered subversive to the objects and purposes of the Memorandum and Articles of the Association.
(d) If a member enters into litigation with another member of the Association without referring the matter to the Association when the other party offers to settle the matter through the Association.
